Maintenance Obligation 18-21 Years in Amsterdam
According to Article 1:395a of the Dutch Civil Code, parents in Amsterdam must contribute to the living expenses and study of children up to 21 years. This applies to married, divorced or single parents, including adoptive and acknowledging parents.
Statutory Basis: Article 1:395a DCC
The obligation continues until 21 years if the child needs maintenance and the parents have the capacity to pay. In Amsterdam, these cases are handled by the Amsterdam District Court, Parnassusweg 220.
Conditions for Maintenance Obligation Amsterdam
Three conditions for a contribution:
1. Age 18-21 Years
Only between 18 and 21 years. At 21 years, it ends automatically, except in case of special agreements.
2. Need for Maintenance
The child must not be able to make ends meet independently. Assessed on:
- Housing, food, clothing
- Study (books, tuition fees)
- Health insurance
- Part-time job or DUO funding
- Savings
Amsterdam judges consider the entire situation.
3. Parents' Capacity to Pay
Only if parents can afford it, based on:
- Net income
- Assets
- Debts and other children
- Rent in Amsterdam (high!)
No capacity to pay? Contribution €0.
Study and Maintenance in Amsterdam
Must You Study?
No study obligation, but not studying or full-time working may stop the contribution. The judge looks at reasonableness.

- MBO, HBO, WO
- Full-time/part-time
Follow seriously! Poor results = risk of termination.
How Much Contribution in Amsterdam?
No fixed amount. Judges use Nibud and Tremar norms, adjusted to Amsterdam costs.
